On Civilian Control: Think Global, Act Local

Much is made in American political mythology of the concept of civilian control of the armed forces. Such discussions are generally limited to the national government, in which the executive is both senior member of that branch and also commander-in-chief of the nation’s military.

Now think, as AWB2013 coalesces towards reality, about the same concepts as applied to state and local government.

At the state level, there is also an elected executive branch official (i.e., the Governor). That elected official has a somewhat-spurious command responsibility over her state’s National Guard forces,* state defense forces, and the state police. Budgetary responsibility for all gubernatorial functions resides with the state’s legislature, although especially in the post-9/11 environment, significant grants and other assistance are supplied (subject to various “strings”, of course) by the Department of Homeland Security and other elements of the Federal government.

At the local level, there is considerable variation in command and control responsibility for local law enforcement, with some areas having an elected chief law enforcement officer (CLEO) (e.g., county sheriffs) and other jurisdictions appointing CLEOs by actions of the county executive, the county legislature, or both.

Regardless of the variations between localities and governmental levels, however, there is in each of your AOs a discernible structure for both direct action (i.e., operational command and control) and logistical/fiscal support for those actions (i.e., funding for those operations).

Make it your business to learn in detail those structures in your area of operations.

Why?

As Feinstein’s proposed legislation is debated and moves towards passage, there are at least two tracks for individual action to halt the madness. There is, of course, the usual “write/contact/visit your Senators and Congresscritter” advice, which will likely have the same effect that such efforts have had against other anti-freedom bills in the recent past (e.g., Obamacare, Patriot Act extensions, NDAA authorizations, debt ceiling increases, et cetera ad nauseum). Notwithstanding the apparent (actual?) futility of such steps, I plan on doing same, and I encourage others to do the same, even if only as a necessary fail.

There is another path, at the local level, which should be considered for execution in parallel. Having determined in your state and your locality the command and support functions for the armed men and women that will be coming (even if only in support of the Feds) to kill you and your family when you defy AWB2013, consider sending letters to those executive and legislative branch officials along the following lines:

As you are also aware, there are millions of such weapons and accoutrements in this state, legally and peacefully owned, by millions of law-abiding citizens. If the Federal legislation is enacted, a very large percentage of those law-abiding citizens will rely on the unequivocal words of the Second Amendment and defy this unconstitutional infringement of their civil rights.

As Commandant of the State Patrol, you and your officers will inevitably be directed by your superiors in the state and Federal government to support Federal forces in the enforcement of this unconstitutional law. While we are confident that you and your officers will want to do the right thing, this letter is being sent to remind you of your duties to the citizens of this state.

If you and your forces actually do your duty and refuse to participate in the enforcement of the Federal law, you will be hailed as a hero in this state and others. You will, of course, be threatened by the Federal authorities, but you know far better than they that the forces at your disposal, even if they were inclined to act as Federal lackeys, are completely inadequate to the tasks you will be assigned.

Stand in defense of this state and its citizens, we implore you.

Stand as an American.

If you and your fellow Senators do your constitutional duty as our representatives and refuse to fund state-supported enforcement of the Federal law, you will be hailed as a hero in this state and others. You will, of course, be threatened by the Federal authorities, but you know far better than they that the use of state forces will lead to unnecessary destruction and bloodshed. Do not allow yourselves to be used as Federal collaborators against the men, women, and children who rely on you to represent them.

Stand in defense of this state and its citizens, we implore you.

Stand as an American.

And that they are responsible for whatever happens in your jurisdiction.
